The first point to note is that there is a difference between condominium and apartment ownership in Thailand. A condominium is structured under a Condominium Title and must conform to the Condominiums Laws. This allows for the sale of Foreign Freehold units.
An apartment does not conform to the requirements under the condominium laws and therefore is unable to offer a Foreign Freehold Ownership. All units are sold on a Thai Freehold basis, meaning Thai buyer or Thai entity can own units freehold or a Leasehold basis to foreigners.
It is also noteworthy that 51% of a Condominium cannot be sold on a Foreign Freehold basis and these units must be sold either Thai Freehold or on a lease structure.
